Guidance on the Consideration of Past Actions in Cumulative Effects Analysis - Withdrawn

In this Memorandum, CEQ provided guidance on the extent to which agencies of the Federal government are required to analyze the environmental effects of past actions when they describe the cumulative environmental effect of a proposed action in accordance with Section 102 of the National Environmental Policy Act (NEPA), 42 U.S.C. § 4332, and the prior CEQ Regulations for Implementing the Procedural Provisions of NEPA, 40 C.F.R. parts 1500-1508.

CEQ issued this guidance for Federal departments and agencies on effective use of programmatic National Environmental Policy Act (NEPA) reviews. The guidance explains the requirements of NEPA and the prior CEQ Regulations when agencies prepare programmatic NEPA reviews. This guidance has been withdrawn by CEQ.

This memorandum provides guidance for Federal departments and agencies on establishing, implementing, and monitoring mitigation commitments identified and analyzed in environmental assessments and environmental impact statements and adopted in final decision documents. It also clarifies the appropriate use of mitigated findings of no significant impact under the National Environmental Policy Act.
