CEQ Report to Congress on Missed Deadlines

Section 107 of the National Environmental Policy Act (NEPA), added in the Fiscal Responsibility Act of 2023, establishes timelines for unified federal reviews under the Act. Section 107(g) establishes a 2-year deadline for agencies to complete environmental impact statements (EISs) and a 1-year deadline to complete environmental assessments (EAs).

Under Section 107(h), the head of each lead agency must submit an annual report to the Committee on Natural Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate identifying EAs or EISs that the agency did not complete by the statutory deadline. The report also must provide an explanation for any missed deadlines for these environmental reviews.

At the request of the Committees, to assist in their review of agency missed deadline reports under NEPA Section 107, CEQ coordinated responses across the Federal government in order to provide a unified submission to report on missed deadlines.

In providing the unified submission, CEQ acted within its statutory function as a primary coordinator and facilitator of the environmental efforts of Federal agencies’ programs. CEQ’s submission does not abrogate any Federal agency’s duties and responsibilities under NEPA. CEQ’s unified submission on behalf of Federal agencies serves to streamline and consolidate environmental information for Congress’s review.

• 2025 Report to Congress on Missed Deadlines (June 17, 2025)

EIS Timelines Report

CEQ has collected data and published three reports on the time taken by Federal agencies to prepare environmental impact statements (EIS) under NEPA.

• 2025 Report: The 2025 CEQ report updates the earlier government-wide EIS data and analysis to now include 1,903 EISs for which a final EIS was published between January 1, 2010, and December 31, 2024.
   

• 2020 Report: In this update to the 2018 report, CEQ compiled data on timelines for 1,276 EISs for which a final EIS was published between January 1, 2010, and December 31, 2018, and a record of decision (ROD) was issued by June 18, 2019.
   

• 2018 Report: In this report, CEQ compiled data on timelines for 1,161 EISs for which a final EIS was published between January 1, 2010, and December 31, 2017, and a ROD was issued by June 7, 2018.
