The One Big Beautiful Bill Act of 2025 amended NEPA by adding Section 112. Section 112 of NEPA allows project sponsors to pay an opt-in fee to obtain expedited deadlines for the completion of environmental assessments (EAs) and environmental impact statements (EIS). Under Section 112, for a project for which a fee is paid, the deadline for completion of an EA is 180 days from the date of the payment of the fee and the deadline for completion of an EIS is 1 year from the date of the notice of intent to prepare an EIS.
Under the statute, a project sponsor that intends to pay the Section 112 opt-in fee for preparation or supervision of an EA or EIS shall submit to CEQ:
A description of the project
A declaration of whether the project sponsor intends to prepare the EA or EIS under section 107(f) of NEPA.
Once CEQ receives all of the information required under the law, CEQ has 15 days to provide the project sponsor notice of the amount of the fee to be paid.
